Copyright Act, 1957

This act amends and consolidates the law relating to copyright in India. It protects original literary, dramatic, musical, and artistic works, as well as cinematograph films and sound recordings.

Copyright registration is a legal process that allows creators to formally protect their original works, such as literary, artistic, musical, and other intellectual creations. While copyright protection automatically applies as soon as a work is created and fixed in a tangible form, registering it offers additional benefits. Registration establishes a public record of the copyright and provides legal advantages, such as the ability to pursue statutory damages and attorney fees in cases of infringement. In most jurisdictions, registration is a straightforward process involving submitting an application, a copy of the work, and a fee to the relevant copyright office. By registering, creators ensure their rights are safeguarded, enhancing their ability to control, distribute, and earn from their work.

When creators register their work for copyright, they solidify their legal standing, which becomes especially valuable in the event of an infringement. Without registration, pursuing legal action can be more challenging, as proving ownership may require extensive documentation and additional steps. Registration also enables creators to license or transfer their copyright with greater ease, facilitating commercial opportunities like publishing, broadcasting, and merchandising.

To be eligible for copyright protection, a work must generally meet the following criteria:

  • Original: Independently created with some creativity.
  • Fixed in Tangible Form: Recorded in a medium like text, audio, or video.
  • A Recognized Work Type: Such as literary, musical, artistic, or digital content (not ideas or methods).
  • Human-Created: Most places require human authorship.

Here’s a copyright eligibility checklist:

  • Originality

    •  Is the work independently created?
    •  Does it have a degree of creativity?
  • Fixed in Tangible Form

    •  Is the work recorded in a tangible medium (text, audio, video, etc.)?
  • Qualifying Type of Work

    •  Does the work fall into a protectable category (literary, musical, artistic, digital, etc.)?
    • ☐ Is it not a mere idea, fact, or method?
  • Human Authorship

    • Was the work created by a human (not solely AI-generated)?

For copyright registration, the following documents are typically required:

  • Completed Application Form: A detailed application form, either online or physical, including information about the creator, title, and type of work.

  • Copy of the Work: A complete copy of the work in a prescribed format (e.g., digital file, printed material, or recording) for official records.

  • Proof of Ownership (if applicable): For jointly created works or transferred ownership, additional documentation may be required, like a transfer agreement.

  • Payment Receipt: Proof of payment of the registration fee.

  • Identification Documents: Some jurisdictions require government-issued ID for verification of the applicant’s identity.

Documents necessary for filing SPICe+ form (INC-32) for the registration of a private limited company are outlined as follows:

A. For Indian Nationals serving as directors and subscribers:
  • Affidavit on stamp paper: a declaration by all subscribers affirming their intention to become shareholders of the company
  • Office address proof like the Rental Agreement or Ownership Deed
  • Electricity bill, water bill and other utility bills of the last two months
  • Copy of approval if required
  • Trademark registration details
  • NOC from property owner
  • Proof of identity and address
B. Required Documents For Foreign Nationals serving as directors/Shareholders
  • Passport: Proof of identity
  • Address proof: Accepted documents include a driving license, residence card, bank statement, or government-issued identification with a valid address.

Types of Copyright Registrations

There are typically three main types of copyright registration, categorized by the nature of the work being registered:

Literary Works

Covers written works like books, articles, blogs, scripts, software, databases, and other text-based creations.

Artistic Works

Includes visual arts such as paintings, drawings, sculptures, architectural designs, graphics, logos, and certain digital art forms.

Musical and Dramatic Works

Encompasses music compositions, lyrics, plays, screenplays, choreographic works, and other performances.

Key characteristics of copyright include:

  • Automatic Protection: Copyright is automatically granted upon creation in a tangible form.
  • Exclusive Rights: Grants the creator exclusive rights to reproduce, distribute, perform, display, and create derivative works.
  • Limited Duration: Copyright generally lasts for the creator’s lifetime plus 50-100 years, depending on the jurisdiction.
  • Transferability: Copyright can be transferred or licensed to others for commercial use.
  • Scope of Protection: Covers original expressions (not ideas or facts) across eligible categories like literary, artistic, and musical works.

To register a copyright, follow these steps:
